Policy

The individual has the right to request CHS amend PHI or a record about the individual in a designated record set for as long the PHI is maintained in the designated record set.
CHS may deny an individual�s request for amendment if it is determined that the PHI or record:
- Was not created by CHS, unless the originator is no longer available to act on the requested amendment;
- The PHI is not part of the designated record set;
- The PHI would not be available for inspection because access would be denied, (see Section 164.524);
- The information is accurate and complete.

| Procedure |
- If a person requests to amend the PHI in possession of CHS, that person shall be directed to the CHS Privacy Officer for instructions on how such a request must be made.
- The Privacy Officer will explain the procedure for requesting an amendment, including the reasons for denial cited above.
- Any request for amendment must be presented in writing for review.
- Upon receipt of a written request for amendment to PHI, the Privacy Officer will review the request in accordance with HIPAA statutes and CHS Policies Section 164 to determine appropriate action.
- Amendments will be limited to the DRS of CHS.
- If CHS accepts an amendment, the PO will be responsible for determination of the steps necessary to inform other entities who need to amend PHI received from CHS.
- The PO is responsible for processing all amendment requests in a manner consistent with CHS HIPAA policies Section 164.
