Policy

A valid authorization is one that meets the description in the following policy.

An authorization is not valid if it has any of the following defects:

  1. The expiration date has passed or the expiration event has occurred;
  2. The authorization has not been filled out completely;
  3. The authorization is known to have been revoked;
  4. The authorization violates any of the standards listed below;
  5. Any material information in the authorization is known to be false.

Compound authorizations are only permitted as follows:

  1. An authorization for the use or disclosure of PHI for a specific research study may be combined with any other type of written permission for the same research study, including another authorization for the use or disclosure of PHI or a consent to participate in such research.
  2. An authorization for a use or disclosure of psychotherapy notes may only be combined with another authorization for a use or disclosure of psychotherapy notes.

CHS will not condition the provision of treatment to an individual on the basis of an authorization with the following exceptions:

  1. CHS may condition research related treatment on the provision of an authorization for the use or disclosure of PHI for such research; or
  2. CHS may condition the provision of health care that is solely for the purpose of creating PHI for disclosure to a third party on provision of an authorization for the disclosure to the third party.

An individual may revoke an authorization at any time, provided the request is in writing, except to the extent that CHS has taken action in reliance of the authorization.

CHS will retain any signed authorizations within the medical record of the patient.
